CBD cannabis (CBD flowers) from EU industrial hemp are legal in Germany

In the Narcotics Act (Narcotics Act - BtMG) Annex I (to Section 1 Paragraph 1) all non-marketable narcotics are listed. This generally includes cannabis (marijuana, plants and parts of plants belonging to the genus Cannabis) but there are exceptions :

(a) their seeds, unless intended for illicit cultivation,
b) if they originate from cultivation in European Union countries with certified seed of varieties (in short: EU industrial hemp) which are listed on 15 March of the year of cultivation in the common catalogue of varieties of agricultural plant species referred to in Article 9 of Commission Delegated Regulation (EU) No 639/2014 of 11 March 2014 supplementing Regulation (EU) No 1307/2013 of the European Parliament and of the Council laying down rules for direct payments to farmers under support schemes within the framework of the common agricultural policy and amending Annex X to that Regulation (OJ L 181 of 20.6.2014, p. 1), as amended, or her Tetrahydrocannabinol (THC) content does not exceed 0.2 percent and trade in them (except cultivation) serves exclusively commercial or scientific purposes, which excludes misuse for intoxication purposes ,
(c) when they are planted as protective strips in beet cultivation and destroyed before flowering,
d) if they are grown by agricultural enterprises that meet the requirements of Section 1 Paragraph 4 of the Law on Old Age Provision for Farmers, with the exception of enterprises in forestry, horticulture and viticulture, fish farming, pond farming, beekeeping, inland fishing and transhumance, or which are eligible for aid under Regulation (EU) No 1307/2013 of the European Parliament and of the Council of 17 December 2013 laying down rules for direct payments to farmers under support schemes within the framework of the common agricultural policy and repealing Council Regulation (EC) No 637/2008 and Council Regulation (EC) No 73/2009 (OJ L 347 of 20.12.2013, p. 608), as amended, and the cultivation takes place exclusively from certified seed of varieties that were grown on 15 March of the year of cultivation in the area referred to in Article 9 of Delegated Regulation (EU) No 639/2014 (industrial hemp) or
(e) for the purposes set out in Annex III –
Regarding Annex III – marketable and prescription narcotic drugs:

cannabis (Marijuana, plants and parts of plants belonging to the genus Cannabis) – only from a cultivation that is under state control for medicinal purposes pursuant to Articles 23 and 28 paragraph 1 of the Single Convention on Narcotic Drugs of 1961, and in preparations which are authorised as finished medicinal products .
